By accessing or using ClipFast ("Service," "Platform," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our Service.

These Terms apply to all users of the Service, including without limitation users who are browsers, vendors, customers, merchants, and contributors of content.

2. Description of Service

ClipFast is an AI-powered platform that enables users to create professional UGC (User Generated Content) videos. Our Service includes:

  • AI-powered video generation using various models (Google Veo, OpenAI Sora, and others)
  • Image generation and composition tools
  • Script generation and editing capabilities
  • Library of AI actors and templates
  • Video customization and export features
  • Subscription plans and credit-based usage

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

3. Account Registration and Responsibilities

3.1. Account Creation

To use certain features of our Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your password and account
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

3.2. Age Requirement

You must be at least 18 years old to use our Service. By using the Service, you represent and warrant that you are at least 18 years of age.

3.3. Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including if you violate these Terms or engage in any fraudulent, abusive, or illegal activity.

4. Acceptable Use

You agree to use our Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Generate, upload, or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
  • Create content that infringes on intellectual property rights, including copyrights, trademarks, or patents
  • Generate content that impersonates any person or entity or misrepresents your affiliation with any person or entity
  • Use the Service to create deepfakes or misleading content intended to deceive
  • Upload content containing malware, viruses, or other harmful code
  • Attempt to reverse engineer, decompile, or extract the source code of our Service
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Interfere with or disrupt the Service or servers connected to the Service
  • Use the Service to compete with us or to build a similar service
  • Share your account credentials with others or allow others to use your account

5. Content Moderation and Review

We use automated content moderation to review scripts and images before processing. We reserve the right to:

  • Reject any content that violates these Terms or our content policies
  • Remove or disable access to content that we determine is harmful, illegal, or violates our policies
  • Suspend or terminate accounts that repeatedly violate our Terms
  • Report illegal content to appropriate authorities

You are solely responsible for the content you create using our Service. We do not endorse or assume responsibility for any user-generated content.

6. Intellectual Property Rights

6.1. Your Content

You retain ownership of the content you create using our Service, including videos, images, and scripts. However, by using our Service, you grant us a worldwide, non-exclusive, royalty-free license to:

  • Store, process, and display your content to provide the Service
  • Use your content for technical purposes (e.g., processing, optimization, delivery)
  • Use anonymized, aggregated data for analytics and service improvement

6.2. Our Service

The Service, including its original content, features, and functionality, is owned by ClipFast and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service.

6.3. Third-Party Content

Our Service may include content, features, or functionality from third parties (e.g., AI models, templates, actors). Such content is subject to the respective third parties' terms and licenses. You are responsible for ensuring your use complies with all applicable third-party terms.

7. Payments, Subscriptions, and Credits

7.1. Subscription Plans

We offer subscription plans that provide monthly credits for video and image generation. Subscription fees are charged in advance on a monthly basis. All prices are in USD unless otherwise stated.

7.2. Credits

Credits are consumed when you generate videos or images. Credits are non-refundable and do not carry over to the next billing period unless otherwise specified in your plan. Unused credits expire at the end of each billing period.

7.3. Payment Processing

Payments are processed securely through Stripe. By providing payment information, you agree to Stripe's terms and conditions. We do not store your full credit card details on our servers.

7.4. Refunds

Subscription fees are generally non-refundable. However, we may provide refunds at our sole discretion in exceptional circumstances. Contact us if you believe you are entitled to a refund.

7.5. Price Changes

We reserve the right to change our pricing at any time. Price changes will not affect your current subscription period but will apply to subsequent renewals. We will notify you of significant price changes in advance.

8. Service Availability and Modifications

We strive to provide reliable service but do not guarantee that the Service will be available at all times. The Service may be unavailable due to:

  • Scheduled maintenance
  • Technical issues or failures
  • Third-party service outages (e.g., AI model providers)
  • Force majeure events

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to notify users of significant changes.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED
  • WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
  • WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM
  • WE ARE NOT RESPONSIBLE FOR THE QUALITY, ACCURACY, OR LEGALITY OF CONTENT GENERATED USING OUR SERVICE

10. Indemnification

You agree to indemnify, defend, and hold harmless ClipFast and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including attorney's fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you create or upload using the Service

11. Cancellation and Termination

11.1. Cancellation by You

You may cancel your subscription at any time through your account settings or by contacting us. Cancellation will take effect at the end of your current billing period. You will continue to have access to the Service until the end of your paid period.

11.2. Termination by Us

We may terminate or suspend your account and access to the Service immediately, without prior notice, if you breach these Terms or engage in any fraudulent, abusive, or illegal activity.

11.3. Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your account and content, though we may retain certain information as required by law or for legitimate business purposes.

12. Dispute Resolution

If you have any concerns or disputes regarding the Service, please contact us first. We will work in good faith to resolve any issues. If we cannot resolve a dispute, it will be subject to the exclusive jurisdiction of the courts in the jurisdiction where ClipFast operates, unless otherwise required by applicable law.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the appropriate courts.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
